Port and Shipping - Guidelines

REQUIREMENTS FOR LICENCING AND REGISTRATION OF REGULATED SERVICE PROVIDERS UNDER THE DIVISION OF PORTS AND SHIPPING SERVICES REGULATION

1.0 SHIPPING AGENCY

1.1  Requirements for Shipping Agency Licence

Applicant for Shipping Agency must have the following qualifications;-

  1. Be a registered company which majority shares are held by Tanzania citizens
  2. Have office premises minimum 18 square meters
  3. Have communication facilities such as; fixed telephone lines, faxes, email, etc
  4. Bank Account
  5. For companies wholly owned by Tanzanian, have capital not less than USD 10,000 or equivalent in Tanzanian Shillings
  6. For companies jointly owned by Tanzanian and foreigners, have capital not less than USD 100,000 or equivalent in Tanzanian Shillings
  7. Maintain solvency ratio of 2:1    
  8. Possess qualified personnel in the shipping industry
  9. Have Agency Agreement with the principal

 

1.2    Application procedures for shipping agency licence.

The applicant must undergo the following procedures during application process

  1. Obtain application form from SUMATRA office or download the same from SUMATRA website.
  2. Submit dully filled in form to SUMATRA for processing and approval
  3. Pay USD20 or equivalent in Tanzanian Shillings, as SUMATRA application fee
  4. Physical inspection of the office shall be conducted prior to issuance of     licence especially for new applicants
  5. Pay USD2000 or equivalent in Tanzanian Shillings, as annual fee upon approval of the application

NB: When submitting the filled-in application form certified copies of the following documents must be enclosed:

  • Copy of previous licence (for renewal)
  • Copy of Business Licence
  • Tariff/Charges for service rendered
  • Copy of Shipping Agency Agreement/Contract
  • Bank Statement for the preceding year of operations.
  • Tenancy Agreement or proof of ownership of office premises
  • List and CVs of Management Staff.
  • List of all employees
  • Audited financial account for the preceding year
  • Agency fee and commission payable by the principal to the agent for services rendered, which should not be below those provided in Shipping Agency (Minimum Agency Fees and Commissions) Regulations, 2011
  • Copy of passport pages showing particulars of passport holder/or berth certificate/affidavit to ascertain citizenship – for the foreigner should include valid work permit
  • Copy of memorandum and article of association
  • Foreign shareholder should provide registration particulars of the company

 

 2.0    CLEARING AND FORWARDING AGENTS

2.1    Requirements for Registration of Clearing and Forwarding Agents

An applicant must abide by the following requirements;-

  1. Have office premises measuring minimum 18 square meters
  2. Have communication facilities such as; fixed telephone lines, faxes, email etc.
  3. Be a registered company
  4. Possess qualified personnel in cargo transport logistics
  5. Payment of Tshs. 10,000 (Tanzania shillings ten thousand only) as  SUMATRA registration fee.

2.2    Application procedures for clearing agency certificate

The applicant must undergo the following procedures during application process;

  2. Submit dully filled in form to SUMATRA for processing and approval
  3. Pay Tshs. 10,000 (Tanzania Shillings ten thousand only) as SUMATRA registration fee
  4. Physical inspection of the office will be required prior to issuance of the licence

NB: During submission, the application form must be accompanied with certified copies of the following documents

  • Certificate of Incorporation
  • CV of Management Staff
  • Tenancy Agreement or proof of ownership of office premises
  • Previous C& F Customs Licence (for renewal)
  • Business Licence
  • Payment Receipt confirming the Registration fee

 

3.0    CARGO CONSOLIDATORS AND DECONSOLIDATORS


3.1    Requirements for Cargo Consolidators and De- consolidators Licence

Following are requirements for cargo consolidators and de-consolidators licence;-

  1. Have office and consolidation/deconsolidation yard premises
  2. Adopt electronic systems which are compatible with other systems including TRA. TPA, ICD, Shipping lines or agents
  3. Have a system of fire control
  4. Possess qualified personnel for the purpose of cargo consolidator and de-consolidator
  5. Have communication facilities such as fixed land line, fax, email etc.
  6. Maintain level of solvency not less than the amount which the Authority shall set from time to time;


3.2    Application procedures for cargo consolidator and de-consolidator licence

The applicant should abide by the following procedures during application process;

  1. Obtain application form from SUMATRA office or download the same from SUMATRA website
  2. Submit dully filled in form to SUMATRA for processing and approval
  3. Pay USD 15 as SUMATRA application fee
  4. Physical inspection of the office shall be conducted prior to issuance of licence especially for new applicants
  5. Pay USD 300 as SUMATRA licence fee upon approval of the application

NB: During submission, the application form should be accompanied with certified copies of the following documents

  • Company certificate of incorporation
  • Company Memorandum and Articles of Association
  • CVs of Management Staff
  • Proof of ownership of Office and Yard premises
  • Bank Account Statement
  • Charges/Fees Tariff
  • Previous licence (for renewal)
  • Fire safety certificate
  • Certificate of compliance from National Environment Management Council
  • Copy of valid insurance cover note for third party liability
  • Any other document which the Authority may require


 
4.0    PORT TERMINAL OPERATORS

4.1    Requirements for Port Terminal Operators licence

The applicant must have the following qualifications;-

  1. Have office premises
  2. Have information and communication facilities such as fixed telephone lines, faxes, email etc.
  3. Possess qualified personnel for the purpose of terminal operations
  4. Maintain a margin of solvency of current ratio of 2:1
  5. Put in place a system of solving complaints and disputes
  6. Have fire safety control system
  7. Have lease, concession, or any other contractual agreement with the landlord or proof of ownership of the land
  8. Possess necessary passenger/cargo handling equipment and facilities
  9. Have a set of performance indicators and benchmarks which are not inferior to those stipulated in SUMATRA (Licensing of Port Terminal  Operators )regulation, 2011

 

4.2    Application procedures for Port Terminal Operators Licence

The applicant must undergo the following procedures during application process;

  1. Obtain application form from SUMATRA office or download the same     from SUMATRA website
  2. Submit dully filled-in form to SUMATRA for processing and approval
  3. Physical inspection of the facility shall be conducted prior to issuance of     licence especially for new applicants
  4. Pay licence fees as prescribed in the second schedule of the SUMATRA     (Port Terminal Operators Licensing) Regulations, 2011

NB. During submission, the application form should be accompanied with certified copies of the following documents

  • Certificate of Incorporation
  • Copy of a valid insurance cover for third party liability.
  • Fire Safety Certificate.
  • Lease, Concession, contractual arrangement between the port terminal operator and the landlord, or title deed of the land      
  • Clearance from Customs Department for suitability to run customs bonded facility
  • Certificate of Environmental Compliance from National Environmental Management council
  • List of passenger/cargo handling equipment available at the     terminal
  • List of ICT equipment available at the port terminal
  • List of performance indicators and benchmarks which are not inferior to those stipulated in SUMATRA (Licensing of Port Terminal Operators ) Regulation, 2011
  • Any other document which the Authority may require.
